If you receive a summons in New York City, your hearing will be held before a Traffic Violations Bureau administrative law judge. The A.L.J. will hear the facts of the case and decide whether to take any license action. If your hearing is held outside of NYC, and you acquire 11 or more points in an 18-month period, the Department of Motor Vehicles will send you a letter asking if you will accept a suspension of your driver’s license for “x” number of days, or if you want a safety hearing. Your chances of success at a hearing are better if you bring an attorney with you to court.
